CARY – Epic Games’ lawsuit against Apple filed in Australia should be thrown out, Apple said in a hearing Tuesday. Epic is resisting the request.

In a hearing, Apple’s legal team said Epic had agreed to settle their disputes over app store fees in a US case that began in August.

Epic expanded the legal battle against Apple to Australia in November.

Epic’s legal team led by Nick de Young insisted Epic dealt with “great competetion harm” in Australia, according to a report from the Australian Associateds Press.

“As Your Honour can appreciate, that is millions and millions of users being harmed by Apple’s conduct,” de Young said. He added that “only one of Epic’s several contracts with Apple mentioned the Californian dispute route” the report added.

The judge scheduled another hearing for March 23.
